Ziele, Inhalte und Methode der Lehrveranstaltung

The lecture gives an introduction to EC cartel law and the Commission's powers to enforce those rules (public enforcement). After a brief introduction on public enforcement of antitrust law in the US the lecture focuses on private enforcement through actions for damages. The latter are common place in the US but still rare in the EU Member States. We will discuss the current legal framework in the EU, based on jurisprudence and the recently adopted Directive 2014/104 on certain rules governing actions for damages under national law for infringements of the competition law provisions of the Member States and of the European Union. The course will elaborate on the differences between the US and the EU systems.

Art der Leistungskontrolle und erlaubte Hilfsmittel

A paper has to be submitted until 31 May 2017.

Mindestanforderungen und Beurteilungsmaßstab

Participants need a very good knowledge of EU law in general, but no prior knowledge of EC cartel law or US antitrust law to follow the course.
