Ziele, Inhalte und Methode der Lehrveranstaltung

The course is taught in English. It is open to students with good knowledge of domestic family law (of their home country) and the ECHR, the case law of the ECtHR as well as very good knowledge of English.
The course introduces students to guiding principles of family law from a comparative law perspective, such as the principle of equality, diversity, pluralism, deregulation, prohibition of discrimination in a variety of legal systems. Starting from the knowledge of domestic family law each student is expected to have, the course focuses on the understanding of family law and the way how guiding principles have shaped certain key features of family law, more specifically the concept of family, marriage, divorce, registered partnerships, consequences of divorce and separation, parentage and surrogacy, and on property regimes.

Art der Leistungskontrolle und erlaubte Hilfsmittel

Regular presence, thorough preparation and active participation in class account for 25 %, the mandatory written exam for 75 %.

Mindestanforderungen und Beurteilungsmaßstab

Students must attend the course regularly. One absence out of four course classes at the most will be accepted. Students who demonstrate the required knowledge of domestic family law by a grade obtained in a seminar, other course type (at least grade “good” ; i.e. “2” or “B”) or by a letter of recommendation shall be given priority. The grade obtained or the letter of recommendation must be sent to bea.verschraegen@univie.ac.at before October 8, 2019. The students admitted to the class will be informed by October 11. Other students can only be accepted, if the maximum number of participants (40 students) is not reached.
Students who do not attend the first session and are unexcused will be deregistered automatically.
Type of materials allowed for the exam: Print-out versions of the legal sources, including case law discussed during the lectures. Please note that you are not allowed to write any comments or annotations into the printed-out documents.

Prüfungsstoff

The mandatory exam will take place on 5 November 2019 and will consist of a critical analysis of a leading decision of the ECtHR and / or a leading decision of a national SCt, which deals with one or more guiding principle(s) of family law.
