Ziele, Inhalte und Methode der Lehrveranstaltung

GOAL: The course aims to familiarise all students with family law conventions and bilateral treaties, EU regulations and international family law (conflict of laws) from an Austrian perspective.
TOPICS dealt with are as follows:
1. (Homework for 9.10.23): Where and how do I find what online?
2. Overview of the authors of the Conventions and the Regulations. Types of legal sources. Unified conflict of laws and substantive law.
3. Geneva Refugee Convention, UN Convention on Stateless Person
4. Hague Convention on the international protection of children
5. Hague Convention on the international protection of adults
6. Hague Child abduction convention
7. Hague Adoption Convention
8. Written test
9. Austrian conflict of laws on family law
10. Agreement Austria-Iran (in German and French), Agreement Austria-Poland (in German and Polish)
11. Rome III-Regulation
12. Hague Protocol on the law applicable to maintenance
13. Written Test
METHOD: The course consists of lectures on the various topics (1-7, 9-12), followed by a questions and answers session

Art der Leistungskontrolle und erlaubte Hilfsmittel

Home work (online), regular oral participation and two written tests (open book exam)

Mindestanforderungen und Beurteilungsmaßstab

Absence in no more than 2 course units, home work at the beginning of the course, regular oral participation and participation in the two tests. The oral participation counts for one third (10 points), the two tests account for two thirds (20 points). A positive grade is achieved with a total of 18 points.
Written tests: very good (1) with 19-20 points; good (2) with 17-18 points; satisfactory (3) with 14-16 points; sufficient (4) with 12-13 points.
Oral participation: at least 6 points out of 10.
Total: 18 out of 30 points for a final positive mark.

Proof of acquired knowledge and of an understanding of the course content.
