In der Woche vom 18.-21.06.2024 werden bei Bedarf mündliche Prüfungen angeboten (s Minimalanforderungen und Beurteilungsmaßstab). Die Studierenden können sich nicht auswählen, ob sie schriftlich oder mündlich zu den Tests / Prüfungen antreten. Eventuelle mündliche Prüfungen stellen ausnahmslos eine exzeptionelle Möglichkeit dar, doch ein positives Gesamtergebnis am Ende des Semesters zu erzielen.

Ziele, Inhalte und Methode der Lehrveranstaltung

GOAL: The course aims to familiarise all students with international treaties and EU regulations which (may) concern family matters, and international family law (conflict of laws) from an Austrian perspective, and aims to train interdisciplinary thinking.
TOPICS dealt with are as follows:
1. Where and how can you find what online? Overview of the authors of the Conventions and the Regulations. Types of legal sources. Unified conflict of laws and national conflict of laws rules (AT-PIL).
2. Austrian international family law - conflict rules
3. Geneva Refugee Convention, UN Convention on Stateless Persons
4. Hague Convention on the International Protection of Children
5. Hague Convention on the International Protection of Adults
6. First written test
7. Hague Child Abduction Convention
8. Hague Adoption Convention
9. Rome III-Regulation
10. Hague Protocol on the Law applicable to Maintenance
11. Sample test
12. Second written test

METHOD: The course consists of lectures on the various topics, followed by a questions and answers session. Students are highly encouraged to participate orally in class.

Art der Leistungskontrolle und erlaubte Hilfsmittel

Participation in both written tests (open book exams). Physical presence is required, because no online exams will be offered.

Mindestanforderungen und Beurteilungsmaßstab

Students must have a basic knowledge of private international law (conflict of laws rules), public international law and family law and be able to communicate well in English in order to intellectually grasp the content of the legal sources (drafted or translated) in(to) English. Preparation for each unit is essential (reading the legal sources).

Absence (limited to health reasons) in no more than 2 course units (medical confirmation required) will be accepted. Participation in both written tests is mandatory. Each test accounts for 10 points. The points of both tests are added together. A positive grade is achieved with a total of 12/20 points (in detail: very good (1) with 19-20 points; good (2) with 17-18 points; satisfactory (3) with 14-16 points; sufficient (4) with 12-13 points).

Two written tests (open book exam). No laptop, tablet, mobile / iphone.
The understanding of the content of the legal sources is examined. Students must be able to solve caes and to answer multiple choice questions.

Students who have not taken BOTH written tests and do not provide medical confirmation of illness, and students who have not achieved the minimum number of points overall (12/20), will be examined orally in the week of 18-21 June (details will be announced later).

Proof of acquired knowledge and of a good understanding of the course content.

The IFL-course is interdisciplinary by nature. Specific books or articles are not available on the market. All issues will be discussed in class. Together with the required basic knowledge of conflict of laws, international law and family law, good preparation for each unit and logical thinking interdisciplinary thinking is trained.
