Aims, contents and method of the course

1. legal theory and theological foundation of canon law:
Like every legal system, canon law aims at compliance by the members of the legal community. If this fails in essential parts, the identity of the community as such is at stake. More than almost any other normative order, the law of the Church is experiencing a crisis of legitimacy. This not only affects the individual baptized, but is particularly drastic where those in official positions of responsibility act -unconsciously or even in full knowledge - against their duty to uphold the order of the community. The handling of abuse cases in the Church shows what a systemic disregard for legal norms can lead to. If canon law is not to degenerate into clerical disciplinary law, the necessity of law in the religious community of the Church must be justified anew.

What is an ecclesiastical office? Are there female office holders in the Catholic Church? How do you get into an office and how do you lose it? What is ecclesiastical authority? How and by whom is it exercised?
3. the right of the ministry of proclamation
The proclamation of the Word of God is the primary essential activity of the Church. In order to ensure that the proclamation of the Church is identical with that which has been entrusted to it as the Word of God, despite all necessary efforts to use contemporary language, the Church also makes use of legal means. The following questions will be addressed in the lecture:
- What is the relationship between ecclesial authority and the sense of faith of the People of God from a legal perspective?
- Who can speak/teach in the name of the Church? What levels of binding force are there for Church teachings and what legal consequences are associated with them?
- What regulations apply to preaching, catechesis, religious instruction and missionary activities of the Church?
- What are ecclesiastical colleges and Catholic universities?
- What legal means are there to safeguard the content of faith?

The course also introduces the basic concepts of canon penal law.

Assessment and permitted materials

The examination takes place as a written examination in presence. A current (!) edition of the CIC without personal notes can be used as an aid. If examinations in presence are not possible due to university regulations, the examination will be a digital oral one(15-20 minutes). In this case, the use of aids such as the CIC is not permitted.

Minimum requirements and assessment criteria

Written examination: A maximum of 27 points can be achieved. The assessment is based on the following grading scale: 25-27 points: (1); 22-24 points: (2); 17-21 points: (3); 14-16 points: (4); 0-13 points: (5). The listing of mere keywords is not counted as an answer.

In the case of an oral examination: the problem of the questions must be assigned to the correct area of law. For a positive performance, each individual question must be answered at least 50% correctly. A "very good" performance means the ability to critically apply the course material to specific questions.
