Aims, contents and method of the course
Assessment and permitted materials
The grade for the course is based on the successful completion of the crash course (first phase of the Clinic) by way of active participation to the sessions and to the development and presentation of mock-up cases. The students will also be asked to complete consultancy work depending on the cases received by the Clinic or contribute to the activities of the Art Law Clinic (e.g. publication of blogposts for the Art Law Clinic Blog - https://viennaartlawclinic.univie.ac.at/blog/ - or any other relevant contributions). The details will be announced at the beginning of the course.
Minimum requirements and assessment criteria
The students must register through u:space and additionally send their resume and a short motivation of interest to join the course and Clinic to artlawclinic.id@univie.ac.at no later than 24 September 2024, 23:59. To apply to the Art Law Clinic, it is not necessary for students to have already completed certain courses. Previous knowledge of art and intellectual property law is certainly an advantage, but not a necessity.
For the successful completion of the course, the students must show continuous participation to the crash course. One-time excused absences are permitted.

Examination topics
Topics of the cases received might vary and at times surpass the topics covered in the course. The students will be expected to do relevant research on the cases under the supervision of the lecturers.

In the first phase of the Clinic, students will receive an overview of topics related to art law, which cover but are not limited to:
- Art and Fundamental Rights: freedom of artistic creation and expression, sources of law referring to this freedom and limits to this freedom, boundaries to artistic freedom from private law (e.g. personality rights) and criminal law.
- Contract Law: types of contracts, acquisition and sale of art works, licensing agreements, interpretation, drafting and concluding of contracts.
- Trademarks & Designs: requirements for protection, rights conferred, whether works of art can be trademarked, integration of famous art pieces into fashion pieces.
- Copyright: originality, authorship, copyright infringement, licensing agreements, exceptions and limitations, orphan works, specific issues regarding digital copyright.
These topics will be complemented by group work on case studies in art law during class.
Law students successfully completing the Art Law Clinic course can offer pro bono and first-hand legal advice and support to art students and young artists as part of the Clinic. In this phase, the students are supervised and supported by the staff of the Department of Innovation and Digitalization in Law.
