Aims, contents and method of the course

The course is taught in English. It is open to students with good knowledge of domestic family law (of their home country) and the ECHR, the case law of the ECtHR as well as very good knowledge of English.
The course introduces students to guiding principles of family law from a human rights perspective. Guiding principles, such as the principle of equality, diversity, pluralism, prohibition of discrimination in a variety of legal systems and ECtHR-decisions will be analyzed. Starting from the knowledge of domestic family law each student is expected to have, the course focuses on the understanding of family law and the interaction with the case law of the ECtHR as well as how guiding principles have shaped certain key features of family law, more specifically the concept of family, marriage, divorce, registered partnerships, consequences of divorce and separation, parentage and surrogacy.
