Aims, contents and method of the course

General presentation of the French system of criminal law (pertaining to civil law; methods and sources of criminal law); criminal procedure and its specificities (principle of opportunity of prosecution; “juge d’instruction”; juries; development of negotiated proceedings); principles of general criminal law (infraction theory; conditions of criminal liability; requirements for exoneration).

Analysis of certain emblematic and recently discussed crimes. Against life and liberty: indecent exposure (Femen cases); fraudulent abuse of a state of ignorance or weakness (Bettencourt affair). Against property: misfeasance (and its application on the misappropriation of buildings). The Court of Justice of the Republic as a specific jurisdiction for ministers of the state (Dupont Moretti affair).

Assessment and permitted materials

Oral exam in the last unit of the course.

Minimum requirements and assessment criteria

Attendance in all course units and passing the exam.
