Aims, contents and method of the course

The course introduces the legal regulation of religions in Belgium and aims to contribute to a better understanding of the diversity of legal systems in Europe. The course is also an opportunity for students to make comparisons with Austrian law, and to identify similarities and differences.
The course successively covers six themes (each in a 3-hour session) 1/ Law and religion: history and Belgian context - 2/ The Belgian system of recognised cults and philosophies - 3/ The issue of sectarian aberrations - 4/ Religion and ethics lessons in schools - 5/ Neutrality and religious symbols: Belgium before the ECHR and the CJEU - 6/ Dialogue mechanisms between public authorities and religions.

Assessment and permitted materials

The assessment of the course is made up of three elements: the preparation (at home) of the readings and active participation in the course (40%), the writing of three short essays of 3 pages on a comparison between Belgium and Austria (20%+20%+20%). There is no final exam.

Minimum requirements and assessment criteria

The assessment takes into account the difficulties associated with studying the law of a foreign country and teaching in French. Any accommodation may be discussed, particularly with regard to the language to be chosen for the written work. The three short written papers are assessed on the quality of the bibliographical research (50%) and the accuracy of the analyses (50%).

The main sources (main legislation, basic literature, selected case law) will be posted on the course moodle.
Methods of public access to web sources of Belgian law will also be presented.
