Information

Aims, contents and method of the course

Thematic focus:
Europeanisation of the legal system and the laws on religion;
Different models of the relation between the state and religious communities within the member states, Religion and European Identity;
Particulatities of the European law on religion;
The religious and belief based dimension within the EU;
Freedom of Religion and Belief unter the European Community Law and unter the European Convention on Human Rights;
European jurisprudence (EJC, ECtHR, the former ECHR);
European labour law and anti-discrimination law;
Sects and new religious movements;
Islam in Europe.

Assessment and permitted materials

1. Participation in class (will be noted at the end of every session).
2. Written exam on June, 19 (approx. 40 min). This exam may be replaced by an oral exam (via a video conference tool) taken until the end of july (individual appointment). The exam questions are taken from a catalogue consisting of 20 questions that is made available to the students in the course of the semester.
Furthermore, on May, 22, the students may take a voluntary exam on the material of the first script at the start of the lecture. The results of this exam may replace the results of the final exam concerning the first script in case of favourability ("Günstigkeitsprinzip").

Minimum requirements and assessment criteria

Attendance is mandatory (you may not be absent more than three times). The grade is constituted by the results of the final exam (66,6 %) and participation in class (33,3 %).

Examination topics

During the semester two documents - written by Brigitte Schinkele and updated by the lecturer - will be uploaded onto the Moodle-platform. Only the catalogue of questions communicated to the students may be subject of the exam.

Reading list

The mentioned documents will contain a good number of references to literature and judicature. However, only the content of the documents will be subject of the exam.
