Information
Aims, contents and method of the course
The subject of the course is the presentation, discussion and application of the main areas of civil procedural law relevant to the examination. The basis for this are selected, significant and/or current cases of legal practice, which are announced in advance. In addition, it is indicated which areas of material are to be worked on to solve the case. In addition, reference is made to special literature. In this way, the compulsory exercise offers all participants the opportunity to prepare efficiently for this exercise, even if you are not yet familiar with this subject in depth.The preparation brings multiple benefits: You as a participant are not only able to deepen your knowledge of the material and eliminate any ambiguities that arise by asking questions in the exercise, but an increased learning effect is also achieved through repetition and application of what has been learned. Contentious issues can be expertly discussed and examined from all angles. Thematic focal points are the proceedings for the recognition of a judgment (JN, ZPO, AußStrG) and the execution proceedings (EO). In particular, the following will be discussed: admissibility of the legal process, domestic jurisdiction, international jurisdiction, jurisdiction, party theory, complaint, subject matter of the dispute, first-instance proceedings, law of evidence, doctrine of judgement, appellate law, appellate actions, general part of the execution proceedings and the execution of proceedings and claims.
Assessment and permitted materials
Written examination or test, term paper or a "mini-test module examination"; written work on the exercise cases or questions relating to the cases (before solving them, approx. 3-5 manuscript pages), oral participation, multiple choice tests. All partial performances can (but do not have to) be completed. Look for minimum requirements and assessment criteria
Minimum requirements and assessment criteria
Entitlement to an exercise certificate exists with a positive assessment of either the written exam/test, or a term paper, or a "mini rehearsal module exam" or the written preparation of exercise cases or the completion of MC tests. If you participate in all/some of the performance assessments, the best assessment will form the basis for the grade.The detailed grade key will be announced on Moodle.
