Aims, contents and method of the course

This seminar will be delivered as a hybrid module (variant 1). In case of a renewed lockdown, it will instead be delivered digitally only.

This module aims at training students fundamental and detailed knowledge and critical understanding of national and international archaeological heritage law and management practice.
Content:
Austrian Heritage Law (Monuments Protection Law DMSG, Environmental Impact Assessment Law UVP-G, Cultural Property Restitution Law KGRG, ratified international conventions [e.g. Hague Convention, UNESCO 1970, Valletta, Faro]) with analysis of relevant Austrian case law/judicature; selected aspects of foreign heritage law (e.g. Bavarian Monuments Protection Law BayDSchG; Baden-Württembergian Monuments Protection Law DSchG-BW; Hessian Monuments Protection Law HDSchG; Schleswig-Holsteinian Monuments Protection Law DSchG-SH; German Cultural Property Restitution Law KGRG and Cultural Property Protection Law KGSG; AMAA 1979; Treasure Act 1996; Heritage [Wales] Act 2016) with analysis of relevant case law/judicature; international conventions (Hague Convention; UNESCO 1970; Valletta; Faro) and Charters (e.g. Lausanne); Monuments Protection in War with a glance at relevant case law.
National and international standards ÖNORM S2411 "Ground Risk Assessment"; European norms EN 15898:2019 "Conservation of cultural heritage. Main general terms and definitions" and draft prEN 17652 "Cultural heritage - Investigation and monitoring of archaeological deposits for preservation in situ".
Archaeological heritage management practice in international comparison (e.g. Guidelines of BDA; Guidelines of Verband Deutscher Landesarchäologen; selected excavation and recording guidelines of German State Heritage Agencies; Technical Advice Notes of Historic England, Historic Environment Scotland; Cadw; EAC Guidelines 1-3; Portable Antiquities Scheme, DIME and other Public Finds Recording systems in comparison with Austrian and German practice).
Critical analysis of the authorised heritage discourse (AHD) and ist consequences for heritage management practice, archaeological archiving and public participation, especially in light of the Valletta and Faro conventions.
