Aims, contents and method of the course

The aim of this seminar is to introduce students to the field of Islamic jurisprudence by way of a close reading of excerpts from Ibn Rushd’s (d. 595/1198) Bidāyat al-mujtahid wa-nihāyat al-muqtaṣid. This will allow us to introduce major questions in the field of uṣūl al-fiqh (i.e. legal methodology and hermeneutics), as well as the so-called furūʿ, i.e. “substantive law”, that is the legal norms of different “schools” or positions of prominent jurists of the formative and classical periods. Our reading of the Bidāya will be supplemented by readings from other sources where necessary (e.g. Ibn Rushd’s commentary on Ghazālī’s Mustaṣfā as well as excerpts from legal manuals of the Mālikī, Ḥanafī and Shāfiʿī schools). We will aim to situate the Bidāya in the broader historical framework of the intellectual and legal history of the premodern Islamic world, as well as the specific context of the Iberian peninsula under the Almohads in the 6th/11th century.

Assessment and permitted materials

1 presentation, 1 final paper, as well as active participation in class (including preparing the text for translation)

Examination topics

Assessment will be by way of participation, class presentation and final paper. There is no separate examination.
