Information

Aims, contents and method of the course

In accordance with the Curriculum of East Asian Economy and Society (EcoS), after completion of this course,

• Students shall have a general understanding of the concept of law and legal philosophy as well as a basic knowledge of the legal history of East Asia
• They will be aware of the individual specifics of the legal system of each country as well as the interaction of the legal system and the respective political reality
• Students will have the necessary theoretical skills to understand and interpret current developments in the field of law and politics from their own legal perspective

To achieve these aims the students will, in the first part of the course, learn about the general concepts of law and legal philosophy. Based on this overview, the legal history of the East Asian countries will be presented and discussed in class. Also, the use of legal materials and laws in scientific research will be covered in part one.

In the second part of the course, the modern legal system of each country will be discussed. The focus will be the constitutional law of each country and its interaction with the political system and the governance of the respective jurisdiction. Also, the theory and of the concept of the rule of law and its individual political interpretation will be examined. To further the understanding and to provide practical examples, current legal issues and affairs will be discussed in class.

In the third part the students will choose an individual topic based on their own interest within the range of the general topics covered in the second part of the course (list of topics provided). After performing scientific research individually, the students will present their findings in class. These will be discussed and after receiving feedback students will write a term paper outlining their findings and their individual conclusions.

• Participation in class, reading the mandatory materials
• Individual presentation
• Feedback and participation in group discussions
• Final paper

Minimum requirements and assessment criteria

Participation in class, reading the prepared materials and preparing for the individual lecture as well as the timely submission of the written term paper are the main criteria for assessment. Regular participation of students is therefore mandatory in this course.

The regular EcoS guidelines and rules on attendance apply.

Examination topics

Students are free to choose the topic of their finally paper individually within the range of topics discussed in class (list of topics provided).

Reading list

A list of basic reading materials will be provided. Students are required to keep up to date on current legal issues, research additional materials as well as perform individual research for their term papers.
