Aims, contents and method of the course

This course introduces the development of Chinese criminal and civila law in the late Qing, the Republican era and in the People's Republic focussing on topics like prisons, the police, inheritance and property.

Assessment and permitted materials

Paper, presentation (individual, group), participation in discussion.

Minimum requirements and assessment criteria

The course aims at making the links between legal, political and social development as presented in the lecture on Chinese law in spring term more visible and understandable in the context of Chinese modernisation by working on specific questions and problems. The analysis and comparison of different texts on these issues is suposed to provide a clearer picture and more critical understanding of these linkages as well as historical changes and continuities.

Examination topics

Introduction by the teacher;
Students and teacher work together on a short outline of Chinese legal history in the late 19th and 20th century;
Analysing texts, comparison of results and presentation by students (individual and in groups);
discussion
