Information

Aims, contents and method of the course

The seminar deals with the confrontation of contrary legal systems and cultures joining the conception of Legal Pluralisme with the theoretical approaches of hegemony (Gramsci, Foucault, Said) with focus on:
*) Break through national legal monopoly in form of:
-) sectoral international Law (F.e. WTO)
-) Free Trade Agreements with external protective clauses
-) EU Agreements of the fourth generation (with democratical and conditional clauses)
*) Internal fragmentation of national legal systems by indigene legal autonomies
*) Legal and constitutional conflicts illustrated by concrete legal institutes (e.g. ownership law, copyright law, common property)

Assessment and permitted materials

*) attendance
*) preparation of a written concept and presentation handout
*) interim and final oral reports on the chosen topic
*) written paper ( 20 p.)

Minimum requirements and assessment criteria

Independent critical analysis of specific legal and constitutional conflicts in Latin America using appropriate theoretical approaches.

Examination topics

*) group meetings to discuss topics and literature
*) presentation and written report on a specific topic
